Refund Policy

1. We do offer monetary refunds – all refunds will be issued in the form of account credit, which can be used at Hyperhost Solutions.

2. We may explicitly grant exceptions to bullet point (1), however this decision is made at our discretion.

3. Account Credit top ups are strictly for use with hyperhost solutions only no refunds will be issued under any condition with a single exception of a duplicate payments on the same day or within 24 hours of making the 1st top up payment for your account credit

Dispute Policy

1. You may be charged administration costs of up to £50

Guidance: We ask that if you wish to ask for a refund that you go through the correct, recommended channels – which is opening a Billing ticket, or by emailing , only authorised contacts on your account will we be able to respond to.

Server & VPS Hosting Unmanaged VS Managed

we offer both Unmanaged & managed Hosting , if you are running a Unmanaged server your backups and data is your responsibility , we “HYPERHOST SOLUTIONS LTD” take no responsability for lost data on our unmanaged services. we reccomend haveing Disaster Recovery solution ready for worst case scenario , we can offer Cloud Based DR backup solution Acronis if required.

Our Managed Hosting Services are Fully managed by us and are backed up every 24 hours with Acronis for worst case scenario , data will be backed up to Acroni’s London Data centre for all managed Hosting Products. customers can request to have data re-located or removed by request.

All VPS Servers are backed up each night , we ask customers to make there own backups , these backups are not intended for daily restoration, it is for disaster recovery reasons only, we offer Full DR for our VPS and Web Hosting only for UK , Germany & France (Dedicated Servers Excluded unless agreement & contract has been signed)

Server Abuse Policy

1. Customers found to be abusing, and or using an HYPERHOST SOLUTIONS services for illegal use will be held fully liable and accountable for any legal proceeding as a result of that action.

2. Customers found to be abusing, and or using an HYPERHOST SOLUTIONS services for illegal use will have there services terminated, and potentially be banned for life from ordering an HYPERHOST SOLUTIONS service.

Running un-confirmed mail lists -> Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited!
Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.
Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronised number sequence attacks) to any other user whether on the HYPERHOST SOLUTIONS network or on another provider’s network.
Sending and or performing of denial of service attacks; this includes flooding of all kinds and other methods associated in the attempt to render a service unavailable.
Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spam Haus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org/rokso.
Unauthorised attempts by a user to gain access to any account or computer resource not belonging to that user.
Unauthorised access to any computer system you have not been given explicit permission to access.
Obtaining or attempting to obtain service by any means or device with intent to avoid payment.
Unauthorised access, alteration, destruction, or any attempt thereof, of any information of any HYPERHOST SOLUTIONS customers or end-users by any means or device.
Using HYPERHOST SOLUTIONS’s Services to interfere with the use of the HYPERHOST SOLUTIONS network by other customers or authorised users. Resource/Node Abuse: HYPERHOST SOLUTIONS reserves the right to cancel or suspend any account which HYPERHOST SOLUTIONS deems to be abusive or over-using resources outlined in the respective Customer’s service plan.
VPS accounts are subject to suspension without notice if it is found to be abusing the VPS node’s resources. Resource/Node abuses include but are not limited to:
Network abuse
I/O Abuse
CPU Abuse
Memory Abuse
This also includes but not limited to:
Denial Of Service Attacks of any kind as stated previously.
Torrent Seed Boxes (Exceptions may be made; please contact support)
Using a proxy or any other kind of IP cloaking methods whilst ordering and or purchasing any HYPERHOST SOLUTIONS service. Failure to comply with this will result in a possible cancellation and or termination of your service and account.

Cancellation Policy

Immediate type cancellations are processed automatically at 5am GMT (Greenwich Mean Time)

End of Billing Period type cancellations are processed automatically at 5am GMT ( Greenwich mean time) on the next service due date.

once a Cancellation has been completed on a Service , all customers data & their backups are sanitised this is a automatic process which will happen on your chosen termination date to termination your services .

All Services Purchased from Hyperhost Solutions must have a Official cancellation request from your client area. an email is not a valid cancellation, if you simply just remove your Bank card / Direct Debit / PayPal your services will be suspended until this is rectified.

all Cancellations must be submitted 30 days before you renewal otherwise admin charges will be incurred & Debt collectors may be issued

Refund Policy

We do not offer monetary refunds under any circumstances unless we have otherwise stated. Any other forms of refunds will be deposited in to your client account as balance.

It is dully noted that the SLA offered with any service is may not take in to consideration any planned maintenance which has had a minimum of seven days advance notice on our dedicated status website found by email.

we do not take responsibility for cancelling automatic payment on behalf of our customers when you terminate a service is it your responsibility to cancel the Mandate or automatic subscription with the payment processor (Gocardless , Stripe or PayPal) , any additional payments that are taken from your account because of a subscription not being cancelled may not be possible to be refunded if your service has been renewed, it you can raise a request for a refund , but Management will make the decision on if you are eligible for a Full refund or partial, all refunds will be subject to a £50 administration charge

Claims Policy

Claiming against Hyperhost Solutions , is against our Terms , creating a claim with any of our Payment processor will result in immediate suspension of your services , all successful claim with our payment processor will result in us issuing Debt Collectors to re-coup cost & proceeding with legal action with our Collection agency.

Service License Agreement

We do not offer any global SLA; however, some services do have explicitly defined SLA’s which will be shown upon ordering of the service.

DDOS (Distributed Denial Of Service) Protection Service License Agreement

Due to the ever changing nature of DDOS (Distributed Denial Of Service) & DOS (Denial Of Service) attacks we can not guarantee that we can protect from all kinds of attack; as it is well noted new attack methods and or variations are created on a daily to weekly basis.

Unlimited Disk Space and or Bandwidth

The use of the word ‘unlimited’, meaning we do not actively limit your account on disk space or bandwidth. However, this is subject to fair use and any customer using an amount of monthly bandwidth or disk space deemed excessive in comparison to the average usage by other customers on our platform may, at our discretion, may be advised to upgrade to another solution which can accommodate their needs.

We provision very large disks for our shared platforms, but no physical or virtual server can have an “unlimited” disk size due to limitations in both hardware and software.

Automatic Payments

By signing up to an automatic payment scheme, and or using one of our various automatic payment options you agree, and allow us to either take and or receive payments on or before the due date to cover any cost of your service. In addition you understand that any new invoices or outstanding debts may be charged automatically.

Our Responsibility

We are not responsibility and or any liability for the following: HYPERHOST SOLUTIONS takes necessary measures to keep your data safe. However, HYPERHOST SOLUTIONS is NOT responsible for lost data, time, income or any other resource due to hardware, software failure or human error. Customer has the full responsibility to keep their data safe and backed up.

Our rights

By agreeing to the terms and conditions you also agree and understand that we hold the following rights over any HYPERHOST SOLUTIONS Service and or client accounts.

We reserve the right to cancel and or terminate any HYPERHOST SOLUTIONS Service that is in violation of these terms and conditions.

We reserve the right to cancel and or terminate any HYPERHOST SOLUTIONS Service; and associated client account found to hold a Fraud Record score of above twenty points. (https://www.fraudrecord.com)

We reserve the right to request identification in the form of government issued identification card such as but not limited to, passports, driving licenses and government issued ID Cards.

We reserve the right to terminate or suspend any service that has not been paid for on or before the due date; (Notice: Please make sure you pay all outstanding invoices before the due date to dissipate any chances of downtime or innocence to yourself.)

Marketing

HYPERHOST SOLUTIONS , does not sent out Spam & Harrasing messages we will in-frequently communicate of new products , Promotion ect if you are enrolled to our marketing emails , if you are not enrolled to marketing , you will still recieve emails for maintenance and planned works

Agreeing to recieve our marketing when you create an account with HYPERHOST SOLUTIONS , you are also agreeing to our Direct Partners to contact you if it deams they would be a good fit for your buisness if there business could assist you in anyway on top of the services we HYPERHOST SOLUTIONS Provide.

if you do not wish our Vetted partners to contact you please kindly raise a ticket to our marketing team and they will make sure your information is not shared with our Authorised Partner network.

Notice

HYPERHOST SOLUTIONS Hosting utilises Fraud Record, and MaxMind to screen new orders for previous fraudulent activity and report existing clients who violate our Terms of Service. In case of a violation, you may be reported to Fraud Record for misbehaviour using one-way hashed information.
